STEP 1 : General Terms of Use and Sale > FOR ALL USERS

Welcome to Wimzzi.com, your marketplace dedicated to discovering and purchasing unique artisanal creations. By using our platform, you agree to these General Terms of Use and Sale (GTU/GTCS), which govern your access to Wimzzi.com and your use of our services.

Wimzzi is operated by Wimzzi SRL, rue des Quilles, 1350 Orp-Jauche, Belgium, company number BE 1005.840.411 (Nivelles).

1. Objective

These GTU/GTCS define the rights and obligations of users (customers) in the context of using the services offered by Wimzzi.com.

2. Definitions

User: Any person who accesses and uses the Wimzzi.com platform.

Customer: A user who places an order on the platform.

Artisan/Seller: An individual or entity that creates or handcrafts unique products or in limited quantities, emphasizing quality, originality, and personal craftsmanship, and who offers and sells their creations on Wimzzi.com.

Order: The act by which a customer commits to purchasing products or services on Wimzzi.com through the process of adding to the cart and validating the purchase on the platform. The order is considered firm and final once the customer has confirmed their selection, provided the necessary information for delivery and payment, and accepted these GTU/GTCS.

Transaction: The complete process, including the payment and delivery of the item from the artisan to the buyer.

3. User account

To access certain features of the platform, you will need to create an account by providing accurate and up-to-date information. You are responsible for the security of your account. Your privacy is important to us. Wimzzi is committed to protecting the personal data of its users in accordance with the GDPR. We ensure transparency in the processing of your data and guarantee your rights to access, rectify, erase, and port your data, as well as the rights to restrict and object to its processing. For any request or exercise of your rights, you can contact us by sending an email to info@wimzzi.com.

4. Intellectual Property

All content published (including texts, images-photos, designs, and logos) on Wimzzi.com remains the property of its authors or Wimzzi. The use of this content without authorization is prohibited.

5. Orders

Wimzzi.com encourage orders directly through our platform to ensure security, transparency, and quality of service for both clients and artisans. Any attempt to conduct transactions outside Wimzzi.com are against our principles of fairness and support for the whole artisan community. This behavior may result in consequences, including restricted access or account deletion on Wimzzi.com.

Each order is subject to the artisan's acceptance and item availability.

6. Payment & security

Payments methods are made through secure means.

Wimzzi.com ensures the protection of payment data in collaboration with authorized payment service providers.

7. Delivery

For orders within Belgium, Wimzzi.com partners with Bpost to facilitate the shipping of your purchases. This collaboration aims to provide a reliable and efficient local delivery option. However, for purchases made from artisans outside Belgium, the responsibility for organizing and managing the delivery lies directly with the artisan. In these specific cases, Wimzzi.com serves as a connection platform and does not intervene in delivery arrangements.

Although we collaborate only with reliable delivery partner, Wimzzi.com cannot be held responsible for any delays or damages that occur during transportation.

If a package is not received due to the buyer's absence or failure to collect it, no refund will be provided. The buyer is responsible for ensuring the package is received or collected on time.

8. Withdrawal condition

We all value thoughtful and responsible purchasing at Wimzzi.com. While supporting the conscious decision-making of our clients, a 14-day right of withdrawal in accordance with the law applies from the date of receipt of the item, except for personalized or custom-made products at your request. We encourage the use of this right in a thoughtful manner, in the spirit of sustainable consumption. In the event of exercising the right of withdrawal, return costs (dependent on package weight) and a handling fee of 2.5% of the total order amount will be your responsibility at your cost. You are also responsible for preserving the quality of the merchandise during its return. You must securely package the item to avoid damage during transportation. Returned items that are used or damaged cannot be refunded. (For any doubt or question, our team remains at your disposal).

9. Warranties and Responsibilities

Articles sold on Wimzzi.com benefit from the legal warranty of conformity and the warranty against hidden defects. This warranty is provided by the artisan/vendor. Wimzzi.com acts as an intermediary between buyers and sellers and cannot be held responsible for product defects sold on the platform. However, we commit to facilitating communication between parties to resolve any disputes.

10. Changes to GTU/GS

Wimzzi constantly evolves to better serve its community. Consequently, we may modify the GTU/GS to reflect these changes. We commit to communicating any significant changes by email or via our platform, giving you the opportunity to review the changes. Your continued use of Wimzzi.com after these changes constitutes your acceptance of the new terms.

11. Applicable Law and Dispute resolution

These General Terms (GTU/GS) are governed by Belgian law, which governs the rights and obligations of the platform, artisans, and clients. In case of dispute, we recommend an amicable resolution. If such resolution is not possible, the Tribunal de l’'Entreprise du Brabant Wallon' will have jurisdiction to hear the case. This approach aims to ensure a fair and transparent experience for all Wimzzi.com users. Our Privacy Policy details the management of your personal data in accordance with the GDPR.

STEP 2 - FOR CRAFTORS ONLY - B2B

General Terms of Use and Sale for Craftor/Vendors/Artisans on Wimzzi.com

As a craftor = vendor on Wimzzi.com, you have access to a unique platform where quality, authenticity, and creativity are at the heart of our mission. Joining Wimzzi.com means you commit to upholding these values and accepting these General Terms of Use and Sale (GTU/GS), which define our working relationship.

1. Registration and access

To sell your creations on Wimzzi.com, creating a craftor/artisan/pro/B2B account is essential. This process involves providing accurate information about your business, including but not limited to legal and banking details, and accepting our Quality and Authenticity Charter.

Registration and management of ‘vendor’ accounts are done exclusively via Wimzzi.com. Vendors/artisans must provide the following information to register on the Site: username; company number and VAT number (if applicable); banking details; postal address of the establishment or headquarters; phone number; email address, legal representative’s name and personal information (name and lastname, date of birth, nationality, country of residence, email address).

Information on these data processing activities is provided in our Privacy Policy.

2. Offers and crafts

As a vendor on Wimzzi.com, you are responsible for ensuring that all information about your crafts including descriptions, images, and any associated titles, labels, or certificates, as well as production locations, are accurate, up-to-date, and not misleading. This is essential to maintaining community trust and ensuring customer satisfaction.

We particularly emphasize the accuracy of titles, labels, and certificates displayed on your profile and products. You must ensure that these distinctions are current and correctly attributed, and we encourage you to perform the necessary checks to confirm their validity. Non-compliance may result in corrective actions, up to suspension or permanent cancellation of your account on Wimzzi.com.

3. Transactions and payments

As a vendor/craftor, you acknowledge that Wimzzi providing services does not imply that Wimzzi assumes all or part of the legal responsibility you bear for transactions.

Wimzzi acts as an intermediary facilitating purchase and sale transactions without assuming responsibility for transactions between vendors and buyers. Under no circumstances will Wimzzi buy or sell items displayed on the site nor claim to do so. This implies acceptance by vendors of the platform's payment methods as well as commissions deducted by Wimzzi.com on each successful transaction.

Shipping Fees: Shipping fees are paid by the buyer for Belgium only (via the integrated system), in addition to the item price, Wimzzi's commission, payment processing fees, and VAT. For countries other than Belgium, you better include the shipping fees in your sale price and handle the shipping arrangements.

Once the transaction is complete, the item price (excluding commission and fees) will be made available (under specific condition based on your pack choice) to you via your e-wallet.

Wimzzi's commission, paid by the customer, varies between 8% and 10% depending on the status.

This commission covers the costs of creating and managing the platform, communication and advertising fees, personnel costs, as well as storage and hosting fees for the information stored on the platform (photos, etc.).

We streamline our costs as much as possible to provide you with the Wimzzi service at the best possible rate. Therefore, to avoid a surge in hosting costs and in line with our values of limiting pollutant emissions, we ask you to avoid leaving dormant items on the platform for several months. This is also why the number of items and photos per artisan is limited based on the status.

4. Status and conditions of sale

5. Delivery

As a creator/vendor, you are fully responsible for the delivery of the sold products on wimzzi.com. For orders within Belgium, Wimzzi has partnered with Bpost to facilitate shipping and ensure reliable and efficient local delivery. You are required to carefully package the items to avoid damage during transport and adhere to the announced delivery times. Please refer to the Bpost packaging guide for further details.

For vendors outside Belgium, it is essential to organize the shipment of sold products according to the same quality and time standards. In case of delays or issues with delivery, proactive communication with the buyer is crucial.

Shipping Obligation. Once the buyer has made the full payment, the Wimzzi system will send you a notification via email. For sellers in Belgium, a prepaid shipping label will be included. You are required to ship the item to the buyer within five (5) business days, unless a different delivery time is specified on your product page (production time).

In case of an illegible, incorrect, or damaged shipping label due to faulty printing, mishandling, or improper cutting, a surcharge of €1 will be applied. This surcharge covers the administrative and technical costs of regenerating the label.

Stock Management and Order Processing

Sellers must keep their stock updated to ensure that the products listed in their shop are actually available. Any item offered for sale must be ready for shipment within the stated delivery time.

If a product becomes unavailable after an order is placed or is not shipped on time, the order will be canceled and refunded to the buyer. In this case, a cancellation fee of 2.5% of the total order amount (including VAT and commission), with a minimum of 5 EUR, will be charged to the seller to cover administrative and transaction costs.

Failure to update stock or poor order management negatively impacts customer satisfaction and the reputation of the platform. In case of repeated issues, Wimzzi reserves the right to suspend or deactivate the seller’s shop to maintain a high level of service for the community.

6. Prohibited items

Wimzzi does not allow vendors/artisans who:

  • Sell items whose sale is prohibited in the country where they may be offered for sale on the Site;
  • Provide a service of renting items;
  • Sell used or pre-loved, second hand items;
  • Sell items that do not meet the description in the 'Quality and Authenticity Charter';
  • Offer for resale items purchased wholesale or generally sold as low-value items in 'dropshipping' (ex items sold at a low price relative to market practices).

7. Rights and obligations

As a vendor, you commit to respecting consumer rights and the platform's regulations.

8. Intellectual property

By posting content and item on Wimzzi.com, you confirm that you hold the necessary rights to this content and authorize its use by Wimzzi.com to promote your items and the platform. This authorization includes adapting your content for marketing purposes while respecting your intellectual property rights. You commit not to infringe on others' rights and to assume all responsibility in case of claims related to your content.

9. Suspension and termination

Your access to Wimzzi.com may be suspended or terminated for non-compliance with these General Terms (GTU/GS) or our Quality charter.

10. Changes to GTU/GS

These general terms of Use and Sale (GTU/GS) may be modified at any time to reflect changes in our services, regulatory developments, or other significant reasons. When significant changes are made, all our users will be informed by email and/or by a clear notification on our platform. By continuing to use Wimzzi.com after these changes take effect, you accept the revised GTU/GS. If you disagree with the modified terms, you have the right to stop using our platform.

11. Applicable law and dispute resolution

Our General Terms of use and sale (GTU/GS) are governed by Belgian law, which governs the rights and obligations of the platform, artisans, and clients.

Any dispute relating to their interpretation, execution, or arising from a relationship with Wimzzi.com will be subject to the exclusive jurisdiction of the Tribunal de l’Entreprise du Brabant Wallon.

In addition to our commitments under the GDPR, as described in our Privacy Policy, we emphasize the importance of protecting our users' privacy and personal data. This Privacy Policy explains how we collect, use, and protect your personal data and how you can exercise your rights under the GDPR. We encourage you to read it carefully. For any questions or concerns about the protection of your personal data, or if you wish to exercise your rights, please contact us at info@wimzzi.com.
