In its wish to support local craftsmanship and independent Belgian businesses even more, Wimzzi.com also offers a showcase for certain shops previously featured on the Belgian e-shops platform. This continuity allows buyers to discover local creators in a professional, secure and structured environment that matches Wimzzi’s values: authenticity, closeness and sustainability.

No personal data has been shared without the explicit consent of the persons concerned. Creators remain fully free to modify, complete or remove their shop space at any time, upon simple request to hello@wimzzi.com. All active shops on Wimzzi.com, whatever their origin, are subject to these General Terms of Use and to the Authenticity and Quality Charter presented during the registration process.

Registration means full and complete acceptance of these conditions.


STEP 1 - FOR ALL USERS

Welcome to Wimzzi.com, your platform dedicated to discovering and buying unique handmade creations. By using our platform, you accept these General Terms of Use and Sale (GTU/GTS), which govern your access to Wimzzi.com and your use of our services.

Wimzzi is operated by Wimzzi SRL, Rue des Quilles, 1350 Orp-Jauche, Belgium, company number BE 1005.840.411 (Nivelles).


1. Purpose

These GTU/GTS define the rights and obligations of users (customers) when using the services offered by Wimzzi.com.


2. Definitions

User: Any person who accesses and uses the Wimzzi.com platform.

Customer: User who places an order on the platform.

Seller: Any individual or legal entity offering products for sale on Wimzzi.com.

Artisan / creator: seller whose activity is based on creating unique pieces or very limited series, mainly made by hand.

Local producer / illustrator: seller whose activity is based on reproducible or partly automated production (food, printing, machines, molds, etc.).

Order: Action by which a customer commits to buying products or services on wimzzi.com through the shopping cart and checkout process on the platform. The order is considered final once the customer has confirmed the selection, provided the information needed for delivery and payment, and accepted these GTU/GTS.

Transaction: Complete process, including payment and delivery of the seller’s item to the buyer.


3. User account

To access certain features of the platform, you must create an account by providing accurate and up-to-date information. You are responsible for the security of your account. Your privacy is very important to us. Wimzzi is committed to protecting users’ personal data in line with the GDPR. We ensure transparency in the processing of your data and guarantee your right to access, correct, delete and transfer your data, as well as your right to limit or object to its processing. 4. Intellectual property

All content published on Wimzzi.com (including texts, images, designs and logos) remains the property of its authors or of Wimzzi. Use of this content without permission is prohibited.


5. Orders

On Wimzzi.com, we encourage orders to be placed directly through our platform to guarantee security, transparency and quality of service for both customers and artisans. Attempts to carry out transactions outside Wimzzi.com go against our principles of fairness and support for the artisan community. This behavior may lead to consequences, including limited access to or removal of the account on Wimzzi.com. Each order is subject to the artisan’s acceptance and depends on product availability.


6. Payment and security

Payments are made through secure payment methods. Wimzzi.com ensures the protection of payment data in cooperation with approved payment service providers.


7. Delivery

For orders within Belgium, Wimzzi.com works with bpost to make shipping easier. This partnership aims to offer a local, reliable and efficient delivery option. However, for purchases made from artisans who have chosen to manage delivery themselves or who are located outside Belgium, responsibility for organizing and handling the shipment lies directly with the artisan. In these cases, Wimzzi.com acts as a platform connecting people and does not intervene in delivery arrangements.

Although we make every effort to work with reliable delivery partners, Wimzzi.com cannot be held responsible for any delays or damage occurring during transport.

If a parcel is not received because of the buyer’s absence or negligence in collecting or accepting it, no refund can be made. It is the buyer’s responsibility to make sure the parcel is properly received or collected on time.


8. Right of withdrawal

At Wimzzi.com, we value thoughtful and responsible purchasing. While supporting conscious buying decisions, a 14-day withdrawal right applies in accordance with the law, starting from the date the item is received, except for personalized or custom-made products made at your request. We encourage the use of this right in a thoughtful way, in a spirit of sustainable consumption.

If the right of withdrawal is used, return costs (depending on the weight of the parcel) as well as an administrative fee equal to 2.5% of the total order amount will be at your expense. You are also responsible for preserving the quality of the goods when returning them. You must pack the items securely to avoid damage during transport. 9. Guarantees and responsibilities

Items sold on Wimzzi.com benefit from the legal guarantee of conformity and the guarantee against hidden defects. This guarantee is provided by the artisan/seller. Wimzzi.com acts as an intermediary between buyers and sellers and cannot be held responsible for defects in the items sold on the platform. However, we are committed to helping communication between the parties in order to resolve any discussion or dissatisfaction.


10. Changes to the GTU/GTS

Wimzzi.com is constantly evolving to better serve its community. As a result, we may modify these GTU/GTS to reflect such changes. We commit to communicating any significant change by email or via our platform, giving you the opportunity to review the changes before they take effect. Your continued use of Wimzzi.com after these changes means that you accept the new conditions.


11. Applicable law and dispute resolution

These GTU/GTS are governed by Belgian law, which regulates the rights and obligations of the platform, artisans and customers. In the event of a dispute, we first aim for an amicable solution. If this is not possible, the Business Court of Brabant Wallon will have jurisdiction to hear the matter. This approach aims to ensure a fair and transparent experience for all users of Wimzzi.com. Our Privacy Policy explains how your personal data is handled in accordance with the GDPR.


STEP 2 - ONLY FOR B2B ARTISANS

General Terms of Use and Sale for Sellers on wimzzi.com

As an artisan, creator or producer selling on Wimzzi.com, you gain access to a unique platform where quality, authenticity and creativity are at the heart of our mission. Joining Wimzzi.com means that you commit to respecting these values and accepting these General Terms of Use and Sale (GTUS), which define our working relationship.


1. Registration and access

To sell your creations on Wimzzi.com, creating a seller account is essential. This process involves providing accurate information about your business, including but not limited to legal and banking information, as well as accepting our Quality and Authenticity Charter.

Registration and management of seller accounts are done exclusively via wimzzi.com. Sellers/artisans must in particular provide the following information in order to register on the Site: username; company registration number and VAT number (if applicable); bank details; postal address of the establishment or registered office; phone number; email address; name of the legal representative and the personal information of this representative (first name and surname, date of birth, nationality, country of residence, email address).

Information on these data processing activities is provided in our Privacy Policy.

Wimzzi.com carries out a thorough verification of the elements mentioned by artisans on its platform and reserves the right to select artisans corresponding to the image Wimzzi.com wishes to convey. In case of refusal, no justification needs to be given.

By registering on wimzzi.com, you join a dynamic platform of artisans and local producers, as well as a community that wants to act for better visibility and recognition of craftsmanship and local production. You therefore agree to actively and positively help this initiative shine on the market and to receive news and updates from Wimzzi.com intended for artisans and for Wimzzi.com customers / prospects.


2. Offers and items

As a seller on Wimzzi.com, you are responsible for ensuring that all information relating to your products, including descriptions, images, any related title, label or certificate, available stock and places of production, is accurate, up to date and not misleading. This is essential to maintain the trust of our community and to guarantee customer satisfaction.

We place particular emphasis on the truthfulness of the titles, labels and certificates displayed on your profile and your products. You must make sure that these distinctions are current and correctly attributed. We encourage you to carry out the necessary checks to confirm their validity. Any non-compliance may result in corrective action, up to and including suspension or permanent cancellation of your account on Wimzzi.com.

When creating your shop and putting your items online (photos, descriptions, titles, etc.), it is strictly forbidden to insert any mention or visual element intended to promote a personal website or an external shop, whether in texts or images. It is also forbidden to insert your logo or your name in product photos through text or through a photo including your business card.

The artisan also agrees that the prices of items offered on the Wimzzi.com platform must be identical to or lower than the prices of these same items offered on other websites or platforms. If a difference is found, Wimzzi.com reserves the right to adjust its prices based on the lowest price offered.

Wimzzi.com is an independent platform dedicated to the collective promotion of artisans and local producers. Any attempt at external redirection goes against our operating principles.

In case of non-compliance with this rule, Wimzzi reserves the right to remove the relevant shop from the platform without prior notice, in order to preserve fairness between all sellers and maintain customer trust.


3. Transactions and payments

As operator of the wimzzi.com platform, Wimzzi provides sellers with a structured environment allowing them to present, promote and sell their creations to buyers. Wimzzi organizes and frames the functioning of the platform, in particular by defining the rules applicable to transactions, payments, shop visibility and services offered to sellers.

Sales made via the platform are concluded directly between the seller and the buyer. Wimzzi is not a party to the sales contract and does not assume legal responsibility related to the products offered, the execution of orders, their shipping or their delivery.

Sellers remain solely and fully responsible for the products they offer for sale, for their compliance with applicable legislation, the accuracy of the information provided, price setting, as well as the packaging, shipping and delivery of orders. They commit to handling each sale seriously, diligently and professionally, in accordance with the legal obligations applicable to sellers and the quality standards expected on the Wimzzi platform.

Payments made by buyers are processed through the platform’s integrated payment system. Wimzzi works with an approved payment provider responsible for processing payments and managing the information related to the payment methods used on the site. Once an order is confirmed, the funds are collected from the buyer on behalf of the seller via Wimzzi’s account and kept secure until the transaction is finalized.

Once the transaction is completed, the sale amount, excluding commissions and applicable fees, is credited to the seller’s e-wallet. The actual release of the funds takes place according to the rules defined by the platform, in particular depending on the chosen visibility pack, the minimum release thresholds and the release frequency linked to the seller’s status.

For sellers based in Belgium, an integrated shipping system may be offered to make shipment management easier. Sellers shipping from outside Belgium remain responsible for organizing their own shipping system and must include delivery costs in their sale price.

The commission applied to each transaction depends on the chosen visibility pack and on the seller category (Artisan / Creator or Local Producer / Illustrator). The applicable commission rates are detailed in Article 4 Status and Visibility Packs. These commissions contribute in particular to the operation and development of the platform, covering the technical costs of platform management, hosting and content storage, communication and promotional actions, as well as the costs linked to operating the service.

In order to guarantee the quality and performance of the platform, and with the aim of limiting technical costs and the environmental impact linked to data storage, the number of items and photos that may be published by each seller may be limited depending on the seller’s status and chosen visibility pack. Sellers are encouraged to keep their shop active and avoid leaving items inactive for long periods.

Wimzzi finally reserves the right to adapt its logistics, pricing or operational policy in order to ensure the proper functioning, security and long-term sustainability of the platform.

4. Status and sales conditions

Creating a user account on Wimzzi.com is free of charge.

To sell on the platform, the seller must activate a “Wimzzi PRO” shop. This activation gives access to the selling features and to the different visibility packs offered by Wimzzi.

For this purpose, Wimzzi distinguishes between two categories of sellers depending on the production method:

Artisan - Creator: production of unique pieces or (very) limited series, mainly handmade.

Local Producer - Illustrator: reproducible or partly automated production, especially in food production or through technical processes (printing, machines, molds, external production workshop, etc.).

The seller’s classification is determined by Wimzzi according to the declared production method and may be reassessed at any time. This classification affects the applicable commissions as well as access to the visibility packs.

The category assigned to the seller determines the applicable commissions as well as access to the visibility packs offered by Wimzzi.

Wimzzi reserves the right to verify, adjust or modify a seller’s classification at any time, especially in case of changes in activity or production method.

Once the registration is validated, the shop activated and the seller category determined, the seller chooses one of the visibility packs offered by Wimzzi.

The financial terms applicable to sellers (commissions, possible subscriptions or additional services) are described in these GTUS and may be completed or clarified through explanatory communications from Wimzzi.com.

Visibility packs define the level of services, communication, prioritization and exposure on the platform. However, Wimzzi does not guarantee any minimum sales volume or commercial result.

For these 2 seller categories on wimzzi.com, three visibility packs are offered: Light, Essential and Business, making six packs in total.

Visibility packs determine the level of visibility, services, support, communication and prioritization granted to the seller on the platform.

For sellers belonging to the Artisan / Creator category, Wimzzi offers three visibility packs: Light, Essential and Business. These packs determine the level of visibility, services, communication and prioritization granted to the seller on the platform.

For sellers belonging to the Local Producer / Illustrator category, Wimzzi offers three visibility packs: Light, Essential and Business. These packs determine the level of visibility, services, communication and prioritization granted to the seller on the platform.

5. Delivery

As a seller, you are fully responsible for the delivery of the products sold. For orders in Belgium, Wimzzi.com has established a partnership with bpost in order to facilitate shipping and guarantee reliable and efficient local delivery. However, you may choose the option “I manage the delivery details and delivery costs myself” if you wish. You must package the items securely to avoid any damage during transport and respect the delivery times announced. Please refer to the Bpost packaging guide for more details.

For sellers located outside Belgium, it is mandatory to organize the shipment of the products sold while respecting the same standards of quality and deadlines. In case of delay or problem linked to delivery, proactive communication with the buyer via the Wimzzi.com team is essential.

Shipping commitment - As soon as full payment has been made by the buyer, the Wimzzi system will send you a notification by email and, for shippers based in Belgium, a prepaid shipping label. You commit to shipping the item to the buyer within five (5) business days, unless otherwise stated on the product page (e.g. production delay).

If a shipping label is unreadable, incorrect or damaged due to faulty printing, improper handling or unsuitable cutting, an extra fee of €5 will be applied. This extra fee covers the administrative and technical costs necessary to regenerate the label. In the event of extra delivery costs resulting from non-compliance with bpost rules, wimzzi.com reserves the right to pass these costs on to the artisan at the rate applied by the delivery provider.

Obligations related to stock and order management - Sellers must keep their stock up to date in order to ensure that the items offered in their shop are actually available. Any product offered for sale must be able to be shipped within the time indicated on the product page.

If an item turns out to be unavailable after an order is confirmed, or if it is not shipped within the expected time, the order will be cancelled and fully refunded to the buyer.

In this case, cancellation and management fees will be charged to the seller in order to cover the payment fees linked to the purchase and refund, invoiced to Wimzzi by payment providers, as well as the administrative fees linked to handling the cancellation.

These fees correspond to 4% of the total amount of the order (including VAT and commission), representing payment fees applied twice (when collecting and when refunding), plus €10 fixed administrative fees.

Poor stock or order management harms customer satisfaction and the platform’s reputation. In case of repeated failures, Wimzzi reserves the right to suspend or deactivate the seller’s shop in order to preserve the quality of service offered to the whole community.

Any shop closure may be requested by the seller, on their own initiative, by email to info@wimzzi.com. Wimzzi also reserves the right to close any shop that has remained empty and inactive (with no items for sale) for more than 20 business days.

The administrative closure of a shop on Wimzzi results in a fixed fee of €20 excl. VAT, intended to cover the technical and administrative operations linked to the closure. These fees remain due even in case of voluntary termination by the seller.


6. Prohibited items

Wimzzi does not allow sellers / artisans who:

sell products whose sale is prohibited in the country where they may be offered for sale on the Site;

provide an item rental service;

sell second-hand or already used items (unless prior approval from Wimzzi.com);

sell items that do not comply with the description in the Quality and Authenticity Charter;

offer for resale items bought in bulk or usually sold as low-value items through dropshipping (e.g. items sold at a very low price compared with market practice).


7. Special rules for food artisans

Artisans offering food products (jams, biscuits, tapenades, chocolates, etc.) must strictly comply with the sanitary and legal standards applicable in Belgium and in the European Union. Artisans must ensure the proper preservation of products during transport and clearly provide information relating to allergens, ingredients and expiry dates on each product page.

The right of withdrawal does not apply to perishable food products or products with a short expiry date, in accordance with the legislation in force.

Fresh products requiring strict and continuous refrigeration (meat, fresh dairy products, refrigerated prepared meals, etc.) are excluded from sale on Wimzzi.com.


8. Rights and Obligations

As a seller, you commit to respecting consumer rights and the rules of the platform.


9. Intellectual Property

By publishing content on Wimzzi.com, you confirm that you hold the necessary rights to this content and authorize its use by wimzzi.com to promote your items and the platform. This authorization includes adapting your content for marketing purposes, while respecting your intellectual property rights. You undertake not to infringe the rights of others and to assume full responsibility in case of any claim linked to your content.

Content produced as part of photoshoots organized by Wimzzi, marketing campaigns or content created by Wimzzi may, subject to specific agreement from Wimzzi.com, be used for promotional purposes for the platform and the sellers concerned.


10. Suspension and Termination

Your access to Wimzzi.com may be suspended or terminated in case of non-compliance with these GTU/GTS or with our quality charter.


11. Changes to the GTU/GTS

These General Terms of Use and Sale (GTUS) may be modified at any time to reflect changes in our services, developments in regulations or other important reasons. When significant changes are made, users will be informed by email and/or by a clear notification on our platform.

By continuing to use Wimzzi.com after these changes come into force, you accept the revised GTU/GTS. If you do not agree with the modified terms, you have the right to stop using our platform.

These new conditions relating to packs, commissions and statuses will come into force on the date communicated by email to sellers.

Continued use of the platform after this date means full and complete acceptance of the new conditions.


12. Applicable Law and Dispute Resolution

These General Terms of Use and Sale (GTU/GTS) are governed by Belgian law, which regulates the rights and obligations of the platform, artisans and customers.

Any dispute relating to their interpretation, execution or resulting from a relationship with Wimzzi.com will fall under the exclusive jurisdiction of the Business Court of Brabant Wallon.

In addition to our GDPR commitments, as described in our Privacy Policy, we emphasize the importance of protecting the privacy and personal data of our users. Our Privacy Policy explains how we collect, use and protect your personal data, and how you can exercise your rights under the GDPR. We encourage you to read it carefully. By accepting these GTU/GTS, you acknowledge that you have read our Privacy Policy and consent to the collection and processing of your personal data in compliance with the GDPR and the applicable data protection legislation.
